Terms of Use

These Terms of Use ("Terms") govern your use of Cowsmic ("the app"), a mobile game published by Betterdays Studio, the trading name of Jonathan Lai, a sole trader based in the United Kingdom ("we", "us", "the developer"). By downloading or using Cowsmic, you agree to these Terms. If you do not agree, please do not use the app. You can reach us at contact@johnnybuildstech.com.

1. Who can use Cowsmic

You must be at least 13 years old, or the minimum age of digital consent in your country, to use Cowsmic. If you are under 18, you may only make a purchase with the permission of a parent or guardian who is responsible for the account being billed.

2. License to use the app

We grant you a personal, non-exclusive, non-transferable, revocable license to use Cowsmic on devices you own or control, for your own personal entertainment and education. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the app, except where the law where you live gives you the right to do so despite this restriction.

3. Purchases and subscriptions

Cowsmic is free to start. The tutorial, the first mission and the lunar training range are free permanently. Cowsmic also offers an optional auto-renewing subscription and an optional one-time "lifetime" purchase, which unlock the remaining sectors.

The price, the billing period, and the length of any free trial are shown to you in the app before you confirm, and by the App Store or Google Play at the moment of purchase. Those displayed terms are the ones that apply to you.

A subscription renews automatically for its stated period unless you cancel it at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends. If a free trial is offered and you buy a subscription before the trial ends, any unused part of that trial is forfeited. A lifetime purchase is a single one-time payment that does not renew.

All purchases are billed and processed by the Apple App Store or Google Play, depending on which platform you downloaded the app from. Subscriptions are managed and cancelled through your App Store or Google Play account settings, not through the app itself or through us directly. Refunds are handled by Apple or Google under their own policies, and we cannot issue a refund for a purchase made through them.

4. Your right to cancel (UK and EU consumers)

If you are a consumer in the UK or the EU, you normally have 14 days to withdraw from a purchase of digital content. Because the app unlocks immediately on purchase, you are asked to agree that supply begins right away, and you acknowledge that you lose that 14-day right of withdrawal once it does. This does not affect your legal rights if the app is faulty or not as described.

5. Content ownership

All game content, including but not limited to artwork, characters, world design, audio, text, code, and the Cowsmic name and logo, is owned by the developer or its licensors and is protected by intellectual property law. Your license under these Terms does not transfer any ownership to you.

6. Acceptable use

You agree to use Cowsmic only for its intended purpose and not to:

• Attempt to hack, exploit, or disrupt the app or circumvent its purchase or entitlement system.
• Submit scores or achievements you did not earn by playing, or otherwise interfere with the leaderboards described in section 7.
• Use the app in any way that violates applicable law.
• Extract, redistribute, or resell any part of the app's content.

7. Achievements and leaderboards

Cowsmic can record your achievements and leaderboard places through Google Play Games Services on Android or Game Center on iOS. Signing in is optional, the whole game works without it, and those services are operated by Google and Apple under their own terms and privacy policies, not by us. We may remove entries we believe were not earned by playing, and we cannot restore, transfer, or correct anything held on your behalf by Google or Apple.

8. Learning outcomes

Cowsmic is a game designed to help you learn French vocabulary and phrases. It is not a certified course, a qualification, or a substitute for formal tuition, and we do not promise any particular level of fluency or any specific result from using it.

9. No warranty

Cowsmic is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not guarantee that the app will be uninterrupted, error-free, or fit for any particular purpose.

10. Limitation of liability

To the maximum extent permitted by applicable law, the developer is not liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, Cowsmic. Nothing in these Terms limits any liability that cannot be limited under the law that applies to you, including liability for death or personal injury caused by negligence, or for fraud.

11. Changes to the app or these Terms

We may update these Terms from time to time. If we do, we will update the effective date above and post the new version at this same address. Continuing to use Cowsmic after an update means you accept the revised Terms. We may also change, suspend, or discontinue parts of the app; if we withdraw a feature you have paid for, we will do what is fair and required by law about the remainder of your purchase.

12. Ending this agreement

You may end this agreement at any time by deleting the app. We may end it if you materially breach these Terms, for example by attempting to circumvent the entitlement system. Any subscription you have bought remains governed by the store's own cancellation and refund rules.

13. Apple App Store users

If you downloaded Cowsmic from the Apple App Store, the following applies in addition to the rest of these Terms:

• These Terms are an agreement between you and Betterdays Studio only, not with Apple, and Apple is not responsible for the app or its content.
• Apple has no obligation to provide any maintenance or support for the app.
• If the app fails to conform to any warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• Betterdays Studio, not Apple, is responsible for addressing any claim relating to the app, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
• Betterdays Studio, not Apple, is responsible for the investigation, defence, settlement and discharge of any third-party claim that the app infringes that party's intellectual property rights.
• You confirm that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and Apple has the right to enforce these Terms against you.

Apple's Licensed Application End User License Agreement (the standard EULA) applies as the minimum baseline terms for your use of the app, in addition to these Terms. You can read it at apple.com/legal/internet-services/itunes/dev/stdeula.

14. Google Play users

If you downloaded Cowsmic from Google Play, these Terms are between you and Betterdays Studio only, not with Google. Google is not responsible for the app or its content, and your use of Google Play is additionally governed by the Google Play Terms of Service.

15. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer resident in another country, this does not deprive you of the protection of the mandatory consumer law of the country you live in, and you may also bring proceedings in your local courts.

16. If part of these Terms cannot be enforced

If any part of these Terms is found to be unenforceable, the rest stays in force.
